Terms of Service

1. Scope

These Terms of Service apply to all agreements between Felix Winkel, SW Labs (Kleingewerbe), hereinafter "Provider", and users of the Bearing platform at app.bearing.report.

2. Service Description

Bearing is an intelligence briefing system that generates structured information briefings based on user-defined contexts. The Provider makes the platform available as a Software-as-a-Service (SaaS).

3. Contract Formation

The contract is formed upon registration and activation of a user account at app.bearing.report. By registering, the user accepts these Terms.

4. User Account

Each user may create only one account. Login credentials must be kept confidential and must not be shared with third parties. Users must notify the Provider immediately upon becoming aware of any unauthorised use of their account.

5. Pricing and Payment

Current prices are listed on the pricing page of the website. Subscriptions renew automatically unless cancelled before the end of the billing period. Billing is in advance. All prices are exclusive of applicable VAT.

6. Cancellation

Users may cancel their subscription at any time effective at the end of the current billing period. The Provider may terminate the agreement with 30 days' notice. The right to terminate for cause remains unaffected.

7. Limitation of Liability

The Provider is only liable for damages caused by intent or gross negligence. Liability for slight negligence is excluded, except for damages arising from injury to life, body, or health.

8. Privacy

Processing of personal data is governed by our Privacy Policy.

9. Changes to Terms

The Provider reserves the right to amend these Terms with 30 days' notice. Changes will be communicated by email. If the user does not object within 30 days, the new Terms are considered accepted.

10. Governing Law

German law applies. Jurisdiction is the Provider's place of business, where the user is a merchant.
